Terms of Service

1. Introduction

Welcome to Mock66. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Fines Software Consulting SRL ("Company", "we", "us", or "our"), governing your use of the Mock66 platform (the "Service").

2. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

3. Account Terms

• Security: You are responsible for maintaining the security of your account and credentials. The Company is not liable for any loss resulting from your failure to comply with this obligation.
• Humans Only: Accounts registered by "bots" or automated methods are not permitted.
• One Free Account: You may not maintain more than one free account to bypass usage limits.

4. User Conduct and Acceptable Use

You agree not to use the Service for any unlawful purpose or in violation of any local, state, national, or international law. Specifically, you are prohibited from:

• Hosting phishing content, malware, or deceptive schemas intended to steal user data.
• Reverse engineering, decompiling, or attempting to derive the source code of the Service.
• Excessive usage that degrades Service performance for others.

5. Subscriptions and Payments

5.1. Merchant of Record

We use Creem.io as our authorized reseller and Merchant of Record. You acknowledge that while Fines Software Consulting SRL provides the software service, the contractual relationship regarding payment processing, tax collection, and invoicing is solely between you and Creem.io.

By subscribing, you agree to be bound by Creem.io's Terms of Service(opens in a new tab) and Privacy Policy(opens in a new tab).

5.2. Management and Refunds

Subscription management (cancellations, upgrades, payment methods) is handled exclusively via the Creem.io Customer Portal linked in your settings. Payments are non-refundable unless strictly required by law.

6. Modifications to the Service

6.1. General Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

6.2. Updates to Plan Limits

We reserve the right to modify the usage limits, quotas, and features included in both Free and Paid (Pro) plans at any time. We may lower or raise these limits at our sole discretion to ensure the sustainability of the Service. While we will attempt to notify users of significant changes, we are not required to provide prior notice for such adjustments.

7. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms (e.g., hosting phishing schemas or attempting to DDoS the platform). Upon termination, your right to use the Service will cease immediately.

8. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Fines Software Consulting SRL. You retain full ownership of the schema data and API structures you create.

9. Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE."

To the maximum extent permitted by law, Fines Software Consulting SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Force Majeure

The Company shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond the Company's reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation, natural disasters, or third-party service provider failures (e.g., Google Cloud Platform or Creem.io outages).

11. Electronic Communications

By creating an account, you consent to receive electronic communications from us. These communications may include:

• Transactional Emails: Notices about your account, password changes, billing information, and other administrative information. These are mandatory for the provision of the Service.
• Marketing Emails: If you have opted in (e.g., via the checkbox at signup), we may send you newsletters, special offers, and promotions. You may opt out of these at any time by following the unsubscribe link provided in the email.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts of Bucharest, Romania.
